Can home-sellers record home tours? It might seem useful to be able to hear buyers’ comments while touring a property, but before you start planting recording devices, you’ll need to know the law.
Florida law requires two-party notice before recording. So, both parties must know recording will be happening in advance.
Additionally, the MLS requires sellers to disclose listening devices, and without proper disclosure, they could be a violation of the REALTOR® Code of Ethics, FREC and brokerage relationship guidelines. Both buyers and sellers could potentially use recording devices, as long as proper disclosure is given to all parties.
